1. Agreement to Terms

By accessing or using SportsFBI ("the Services"), including the BlowOutAlert workspace and related features, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the modified Terms.

2. Description of Services

SportsFBI provides real-time NBA analytics, daily fantasy sports (DFS) tools, and data visualization services, including:

• Live game scores and statistics updated every 5 seconds
• Player archetype classification and analysis
• AI-powered matchup intelligence and verdicts
• Advanced basketball statistics and metrics
• Injury tracking and predicted lineups
• Vegas betting line integration
• Play-by-play analysis and interactive workspace features

Services are provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free service.

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account by providing accurate and complete information. You may register using your email address or through Google OAuth.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

• Use a strong, unique password
• Not share your account with others
• Notify us immediately of any unauthorized access
• Log out from shared devices

3.3 Account Eligibility

You must be at least 18 years old to create an account and use our Services. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.

4. Subscription Plans and Billing

4.1 Subscription Tiers

We offer multiple subscription tiers (Free, Pro, Elite) with varying features and access levels. Subscription details, features, and pricing are available on our pricing page.

4.2 Payment Terms

• Subscriptions are billed in advance on a recurring basis (daily, weekly, or monthly)
• Payment is due at the start of each billing period
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method for all applicable fees
• If payment fails, we may suspend or terminate your access to paid features

4.3 Price Changes

We reserve the right to change our pricing. Price changes will not affect your current billing cycle but will apply to subsequent renewals. We will notify you of price changes at least 30 days in advance.

4.4 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• No partial refunds are provided for unused time
• After cancellation, you will retain access until the end of the paid period
• Free tier features will remain available after cancellation

5. Acceptable Use Policy

You agree not to use the Services for any unlawful or prohibited purpose. Prohibited activities include but are not limited to:

• Violating any applicable laws or regulations
• Infringing on intellectual property rights
• Attempting to gain unauthorized access to our systems
• Scraping, crawling, or harvesting data through automated means without permission
• Interfering with the proper functioning of the Services
• Transmitting viruses, malware, or other harmful code
• Impersonating another person or entity
• Using the Services to create derivative products or compete with us
• Sharing API access or circumventing subscription limitations
• Reselling or redistributing our data or Services without authorization

6. Intellectual Property Rights

6.1 Our Content

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, data compilations, software, and the proprietary archetype engine, are owned by SportsFBI or our licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use in accordance with these Terms. This license does not permit you to:

• Modify, copy, or create derivative works
• Reverse engineer or decompile our software
• Remove copyright or proprietary notices
• Transfer, sublicense, or resell access to the Services

6.3 Third-Party Data

Our Services integrate data from third-party sources (NBA statistics, betting lines, etc.). Use of such data is subject to the terms and conditions of those third parties and applicable laws.

7. User-Generated Content

If you submit feedback, suggestions, or other communications to us ("User Content"), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and incorporate such User Content into our Services without compensation or attribution.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties regarding accuracy, reliability, or completeness of data
• Warranties that the Services will be uninterrupted, secure, or error-free

IMPORTANT: Our Services provide analytics and information for entertainment and research purposes only. We do not guarantee outcomes or winnings in daily fantasy sports contests. You are solely responsible for your Sportsbooks and Daily Fantasy Sports decisions and any financial risks you undertake.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPORTSFBI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Loss of use or business interruption
• Costs of substitute services
• Sportsbooks and Daily Fantasy Sports contest losses or unsuccessful lineups

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless SportsFBI and its affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of applicable laws or regulations

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or through your account settings.

11.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms or engaged in prohibited activities.

11.3 Effect of Termination

Upon termination:

• Your right to access and use the Services will cease immediately
• We may delete your account data in accordance with our Privacy Policy
• You will not be entitled to any refunds for prepaid fees
• Sections of these Terms that by their nature should survive will remain in effect

12. Dispute Resolution and Arbitration

12.1 Informal Resolution

Before filing a claim, you agree to contact us to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

12.2 Binding Arbitration

If informal resolution fails, you agree that any dispute arising from these Terms or the Services will be resolved through binding arbitration rather than in court, except for disputes that may be brought in small claims court.

Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be held in [Your State/Location] or remotely via video conference.

12.3 Class Action Waiver

You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class action, consolidated action, or representative proceeding.

14.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet outages.

14.6 Third-Party Services

The Services may integrate with or link to third-party services (DraftKings, FanDuel, etc.). We are not responsible for the availability, content, or practices of these third-party services.

15. Daily Fantasy Sports Disclaimer

IMPORTANT NOTICE: SportsFBI provides analytical tools and information related to NBA basketball and daily fantasy sports. However:

• We are not a gambling operator or Sportsbooks/Daily Fantasy Sports platform
• We do not host contests or accept wagers
• Our analytics are for informational purposes only
• Past performance does not guarantee future results
• You are solely responsible for compliance with Sportsbooks and Daily Fantasy Sports laws in your jurisdiction
• Daily fantasy sports may be prohibited or restricted in certain locations
• You should only risk what you can afford to lose

16. API Access Terms

If you have API access as part of an Elite subscription:

• You must comply with rate limits and usage restrictions
• You may not share API keys or credentials
• You may not use API data to build competing services
• We may modify or discontinue API access at any time
• API access is subject to separate technical documentation

17. SMS Notifications Program

SportsFBI operates an SMS notifications program that allows registered users to receive automated text message alerts related to the Services.

17.1 Enrollment

You may enroll in SMS notifications by providing your mobile phone number and checking the opt-in box in your account profile. By enrolling, you expressly consent to receive recurring automated SMS messages from SportsFBI / BlowoutAlert. Consent is not a condition of purchasing any product or service.

17.2 Message Frequency

Message frequency varies based on the alert types you enable and the number of games on the active slate. You may receive up to several messages per day on days with active game slates. Individual alert types can be toggled on or off from your account profile at any time.

17.3 Message and Data Rates

SportsFBI does not charge for SMS notifications. Message and data rates from your wireless carrier may apply. Check with your carrier if you are uncertain whether text messages incur a charge under your plan.

17.4 Opt-Out

You may opt out at any time by replying STOP to any message you receive from us. After sending STOP, you will receive one final confirmation message and will receive no further SMS messages. You may re-enroll at any time through your account profile.

For assistance with the SMS program, reply HELP to any message you receive from us, or reach us through our contact page.

17.6 Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to effective transmission by your wireless carrier and is outside of SportsFBI's control.

17.7 Supported Carriers

The SMS program is available on major U.S. wireless carriers including AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, and others. Coverage may not be available on all carriers or in all areas.
